Unemployment Insurance Appeals Board
The Unemployment Insurance Appeals Board (UIAB or Board) is composed of three members of the public, appointed by the governor, who are not state employees. Mont. Code Ann. § 2-15-1704. The Board is quasi-judicial and typically meets monthly to review and consider unemployment insurance cases appealed from the Office of Administrative Hearings (OAH). Mont. Code Ann. § 39-51-2404. If a party wants to appeal the OAH decision, the party must do so within 10 days after the OAH decision was sent to the interested party’s address of record or the OAH decision is final. Mont. Code Ann. § 39-51-2403. The 10-day period may only be extended for good cause, which is defined in Admin. R. Mont. 24.40.101(12).
The Board reviews the administrative record, or portions of the record transmitted on appeal, considers parties’ timely filed written arguments, and oral arguments of parties who appear before the Board at the time of the review proceeding. Admin. R. Mont. 24.7.306(1). The Board reviews OAH decision for errors of law or fact and will determine whether a decision was based on substantial evidence. Id. at (3). Instructions and Forms to Appeal Board Decisions
If you are dissatisfied with the Board’s decision, you have the right to appeal it by filing a Petition for Judicial Review within 30 days after the decision was sent to you. Mont. Code Ann. § 39-51-2410(1)(a). Petitions for judicial review are governed by Mont. Code Ann. § 39-51-2410.
